These terms govern the use of the BagPacker app and the associated pages at getbagpacker.com.
The provider of the BagPacker app is:
Nils Egbers
Borkumstraße 12B
13189 Berlin
Germany
E-Mail: bagpacker.app@gmail.com
These Terms of Service govern the use of the BagPacker app on iOS and Android as well as
the pages at getbagpacker.com. Conflicting terms of the user do not apply, even
if they are not expressly objected to.
Two further documents apply in addition, and they form part of these terms:
BagPacker creates packing lists. You answer a few questions about your trip - destination, dates, occasion, travel companions and the like - and the app assembles a list from them using a fixed set of rules. You can then edit that list, add to it, check items off, export it as a PDF and share it with others.
Depending on the version, the feature set includes in particular:
And now the part that matters just as much: BagPacker is a suggestion tool, not a guarantee. A generated list is a non-binding recommendation. It may contain items you do not need, and - the practically more important case - it may fail to contain items you urgently need. What you actually pack is your decision and your responsibility. This applies expressly to things that matter a great deal: travel documents, medication, equipment for particular weather conditions or sports, and anything that is mandatory for your trip.
BagPacker does not provide travel advice, medical advice, or information about entry, customs or vaccination requirements. Weather information comes from a third party (Open-Meteo) and consists of forecasts, not assurances.
When you first start the app and accept these terms, a free user agreement covering the basic features is formed between you and the provider. There is no entitlement to the conclusion of this agreement.
You can use the basic features without registering; your lists are then stored on your device only. For shared lists, the app issues a technical identifier without requiring you to provide a name or email address.
For individual features you may voluntarily sign in with your Apple or Google account. You are responsible for keeping the credentials for that account out of other people's hands. If you notice unauthorised use, please let us know.
Use of BagPacker is permitted from the age of 16. If you are younger, you may only use the app with the consent of a parent or guardian. Paid offerings may only be purchased if you have full legal capacity or the consent of your parent or guardian.
Beyond the basic version, BagPacker offers a paid product called BagPacker Pro. Which features it includes in each case is shown in the app immediately before purchase. The scope may develop over time; Section 9 governs what applies in that case.
BagPacker Pro is offered in the following forms:
This is the most important point in this section. The purchase of BagPacker Pro is processed through Apple's App Store or Google Play. The purchase contract is formed between you and the respective store operator, not between you and the provider of this app. The terms of the respective store apply.
This has three practical consequences for you:
A subscription renews automatically for the term selected unless you cancel it at the latest 24 hours before the end of the current period. The charge is made through your store account.
Where a free trial period precedes the subscription, it converts automatically into a paid subscription at its end unless you cancel beforehand. The length of the trial period is shown to you before purchase. If you cancel during the trial period, no costs are incurred.
You cancel a subscription in the settings of your store account:
Uninstalling the app does not cancel a subscription. After cancelling, you keep access until the end of the period already paid for.
If you change devices or reinstall the app, you can reactivate an existing purchase using the Restore purchases function. This requires you to use the same store account with which the purchase was made.
Consumers have a statutory right of withdrawal for distance contracts.
Because the purchase contract for BagPacker Pro is formed with the respective store operator (Section 4.3), your right of withdrawal and your right to a refund are governed by that operator's terms and are exercised there. Apple and Google provide their own forms for this purpose.
The free user agreement under Section 3 involves no costs for you; you can end it at any time without notice by uninstalling the app or deleting your account.
Should a paid contract be formed directly with the provider in an individual case, the following applies: you may withdraw from that contract within fourteen days without giving reasons. The period begins when the contract is formed. A clear statement by email to bagpacker.app@gmail.com is sufficient to exercise this right. For digital content, the right of withdrawal expires early if you have expressly agreed that performance should begin before the withdrawal period has expired and have confirmed that you thereby lose your right of withdrawal.
You can enter your own text in BagPacker - list titles, categories, items, names of travel companions and display names. You are responsible for this content.
As soon as you share a list, everyone involved can see what is in it - including the names you have assigned. So consider before sharing which details you want others to see. In particular, other people's personal data does not belong in a shared list if those people have not agreed to it.
The House Rules for shared lists apply to every shared list. They form part of these terms and are available in the app. They prohibit in particular insults, harassment, threats, hateful content, sexual content, depictions of violence, advertising and spam, as well as unlawful content.
You can report a shared list in the app; you will find the function in the list under Settings, with the members. We review every report. In the event of violations, we may remove reported content, block access to a shared list and, in serious or repeated cases, block accounts. In addition, whoever created a list can remove participants at any time.
Your content remains yours. You merely grant the provider the non-exclusive, territorially unlimited and freely revocable right to store and reproduce this content and to display it to the people you share it with - and only to the extent necessary to operate the app. No further use takes place, in particular no publication and no disclosure for advertising purposes.
You undertake:
For individual items, BagPacker may display a link to a partner shop. Such links are advertising links: if a purchase is made through such a link, the provider may receive a commission. The price does not change for you as a result.
The purchase contract is formed exclusively between you and the respective shop. That shop alone is responsible for its offering, prices, delivery and warranty. There is no obligation to use such offers.
We endeavour to provide trouble-free operation, but cannot guarantee uninterrupted availability. Maintenance work, disruptions at service providers and circumstances beyond our control may lead to interruptions. Features that depend on the internet - shared lists, weather information, sign-in - are not available without a connection.
We provide updates that are necessary to maintain conformity with the contract, including security updates, and inform you about them. This applies for the period you may expect given the nature and purpose of the app.
Beyond that, we may change the app where there is a valid reason - such as technical development, adaptation to a changed legal situation or a change at a service provider we use - provided that this causes you no additional costs and does not significantly impair you. If a change significantly impairs access or usability, we will inform you in good time and you may terminate the agreement free of charge within 30 days.
We reserve the right to discontinue operation of the app. In that case we will inform you with reasonable notice. Amounts already paid for a period not yet used will be refunded pro rata; processing follows Section 4.3.
The statutory provisions apply, in particular sections 327 et seq. of the German Civil Code (BGB) for paid digital products. Your statutory rights are not restricted by these terms.
Please report defects to bagpacker.app@gmail.com. A description that is as precise as possible - what you did, what happened, which device and which app version - helps us find the error; it is not a precondition for your rights.
The provider is liable without limitation
In cases of ordinary negligence, the provider is liable only for breach of an obligation whose fulfilment is essential to the proper performance of the contract and on whose observance you may regularly rely (cardinal obligation). In such cases, liability is limited to the foreseeable damage typical for this type of contract.
Liability is otherwise excluded.
And expressly, because it belongs to this app: the provider is not liable for disadvantages arising because an item was missing from a generated list, appeared there wrongly, or was overlooked while packing. A packing list is a suggestion; the decision about what to take with you is yours (Section 2). The same applies to weather data from a third party and to content that other users enter into shared lists.
These provisions also apply for the benefit of the provider's legal representatives and vicarious agents.
The free user agreement runs for an indefinite period. You may end it at any time and without notice by uninstalling the app or - if you have created an account - deleting that account in the app. Deleting the account removes the data stored by the provider in accordance with the Privacy Policy.
A running subscription is not affected by this - it must be cancelled in the store (Section 4.5).
The provider may terminate the free user agreement giving 14 days' notice. The right to extraordinary termination for good cause remains unaffected for both parties; for the provider, good cause exists in particular in the event of a serious or repeated breach of Section 6 or 7.
We may change these terms where this is necessary for a valid reason - such as a change in the legal situation, a supreme court decision, a change in the feature set or an adjustment at a service provider we use.
We will inform you of a change in the app at least 30 days before it takes effect. If you do not object before it takes effect, the change is deemed accepted; we will draw your attention to this consequence separately in the notice. If you object, you may terminate the agreement free of charge up to that point in time.
The provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (section 36 of the German Act on Consumer Dispute Resolution, VSBG).
This does not prevent you from contacting us directly first if there is a problem - as a rule, that is the fastest route: bagpacker.app@gmail.com.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are habitually resident in another state, the mandatory consumer protection provisions of that state remain unaffected.
Should any provision of these terms be or become invalid, the validity of the remaining provisions shall not be affected. The statutory provisions shall take the place of the invalid provision.
The version of these terms currently in force is available at getbagpacker.com/legal/terms.en.
